8.1 These Terms and conditions will be governed by and construed in accordance with English law, and any disputes arising in relation to these terms will be subject to the jurisdiction of the courts of England and Wales.

  • J Brady Garage Doors is a trading name of J Brady Garage Doors Limited – The company number is 15486657, VAT number is GB 765 346 017, and its registered address is at 69-75 Thorpe Road, Norwich, England NR1 1UA. Our trading address is 20 High House Avenue, Wymondham, Norwich NR18 0HY.

  • You will grant us access to the premises during our normal working hours Monday – Friday, excluding Public Bank Holidays to carry out the agreed works. You agree to provide access to services and facilities such as electricity, water, and toilets at no cost. You also agree that, where necessary, you will allow us to bring skips, ladders, scaffolds, or vehicles on to the premises.
     
  • Whilst we will use our best efforts not to cause any damage to surrounding brick or plasterwork during our garage door installation, some damage can be inevitable during the process of removing the old door. It is your responsibility to make good of any damage in those circumstances. With our third party contractor, we can make good at an additional cost.
     
  • We shall send you our formal written warranty once we have received payment of the balance due to us.
     
  • Our products are made to measure and are not sold “off the shelf”. As they are bespoke products, you do not have any right to cancel this contract in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where those regulations apply. As a result, all deposits are non-refundable.
     
  • The final balance of the purchase price is payable on completion of the installation. Payments can be made by cash or card and if the balance is not paid in a timely manner, J Brady Garage Doors will seek assistance from a third-party company, of which, their fees will be added onto the balance.
  • We work on a fixed price agreement, meaning the price we offer is the price you pay. Any further works are to be paid in full at the time of order.
  • It is your responsibility to ensure that we can access your garage and its immediate vicinity to carry out our garage door installation and that you have removed any obstructions prior to our arrival so that we have unhindered access to carry out our works.
     
  • We do not carry out any enquiries as to what consents may be required and it is your responsibility to ensure that you have obtained at your cost any consent that may be required for the contract to proceed. Such consents include, but are not limited to, those applicable to listed buildings, conservation areas or situations where Landlord or Freeholder consent is required.
     
  • We do not undertake to remove the door that we are replacing intact and shall dispose of the old door at the end of the garage door installation in such manner as we see fit.
     
  • We undertake to repair or replace, free of charge, any products supplied by us which prove defective because of faulty materials or workmanship within the following periods from the date of your garage door installation. This does not affect your consumer rights and right to redress under the Consumer Rights Act 2015.
  • J Brady Garage Doors will not be liable in respect of any defect arising from wear and tear, wilful damage, negligence, abnormal working conditions or failure to follow the instructions (whether verbal or in writing) including but without limitation: (a) electrical work external to the product; (b) transportation or relocation of the product not by the supplier; (c) any error or omission relating to the product; (d) any modification, adjustment or repair to the product made by a third party without the written consent of the supplier; (e) the subjection of the product by the customer to unusual physical or electrical stress; (f) the door striking an immovable object during travel; (g) failure of electrical power, or any other cause which is not due to the neglect or the default of the supplier, its employees, agents or subcontractors.   • We are happy to provide samples and will do our best to match the samples. If the final product doesn’t match the sample (colour variations, marks or defects), it will be brought to your attention before the final payment.
     
  • We will use our best efforts to honour any installation date given, but on occasions we may be forced to cancel installations at short notice. Such factors include, but are not limited to, adverse weather, traffic conditions, mechanical breakdown, or illness. If we are unable to meet an installation date, we shall give you as much notice as possible and arrange an alternative convenient date, but we shall not be liable for any losses that you may have suffered because of any such cancellation or delay.
  • Rolling garage doors by nature of their rolling operation, compressing aluminium upon aluminium can produce roll marks, and sometimes minor scratches which is a natural occurrence over any period of time. Roll marks may also appear in and around the side channels. These are not defects and will not interfere with the normal operation of the door, nor compromise the life or deterioration of the door.
  • Hörmann’s timber door are made from a natural product. Impregnation at the factory protects the timber from blue stain and fungal decay. Cracks resulting from dryness and shrinkage are unavoidable due to weather conditions. These cracks may occur more or less frequently depending on humidity; as with colour variations and dimensional tolerances,
    they are not considered a defect as outlined in DIN or TÜV regulations, and they do not interfere with the strength, durability or safety of the products. The timber door must be protected with a pigmented, open-pore glaze for protection against further strains such as humidity, temperature change and UV radiation.
